Advisory for Indian nationals on birth certificate of children

born out of interfaith marriages

It has been brought to the notice of the Embassy of India that children born out of interfaith wedlock, especially if one of the spouses is a Muslim, amongst Indian nationals in the UAE are not being issued due birth certificate by the concerned local health authority in accordance with the local legal system. The Embassy is in touch with relevant UAE authorities on this issue for an amicable solution.

2. While, all Indian nationals in the UAE are advised to adhere and follow the local legal provisions, the prospective parents of interfaith marriages, especially involving a Muslim and a non-Muslim spouse may consider having the delivery of their expected child in India rather than in the UAE to avoid any local legal issues in obtaining a birth certificate for the child from the local health authorities in the UAE.

3. The local hospitals are also requested to kindly make prospective parents of interfaith marriages, especially Muslim and non-Muslim amongst Indian nationals aware of the prevailing legal requirements that could complicate issuance of a birth certificate by UAE health authorities at a later stage. This would certainly help the prospective parents of interfaith marriages to take an informed decision on choosing the place of delivery for the birth of their child and prevent any future legal complication in getting a birth certificate in the UAE.
