Procedure For Marriage Solemnization/Registration

Marriages between the two individuals, at least one of whom is an Indian citizen with a residence visa of the UAE, are solemnized / registered at the Consulate General of India, Dubai, under Foreign Marriage Act, 1969. 

Marriages, where either bride or groom or both are Muslims, are not solemnized at the Consulate. In this case, local authorities in UAE are to be contacted. If the couple got married in India, they have to register their marriage in India only with concerned authorities.

Timings for submission of forms at Consulate as prescribed in the Procedures of Marriage Registration, Step-1 are from Monday to Thursday between 8.30 a.m. to 12 noon and on Friday 8.30 a.m. to 10.30 a.m. only, no prior appointments are required. 


A. PROCEDURE FOR MARRIAGE SOLEMNIZATION/REGISTRATION AT THE CONSULATE:

Step-1: Prospective couples may approach the Consulate through e-mail, walk-ins or phone for inquiries. Physical presence of bride, bridegroom & 3 witnesses along with original passport and EID are required on the day of submission of documents for solemnization & registration of marriage as well as on the day of actual marriage solemnization & registration. Photocopy of passports and EIDs of bride, bridegroom and all 3 witnesses are required only at the time of submission of forms.

Step-2: After submission of Form, Newspaper Notice is to be given by the couple for publication in local English Newspaper (UAE) as well as in a popular state-level popular newspaper in India  (at the place of permanent residence as indicated in the passport). The newspaper advertisement should contain the full text in ENGLISH as sample provided by the Consulate.

Step-3: After the publication of the newspaper advertisement, the newspaper needs to be submitted in original. A date, at least 30 days from the date of last publication of the notice is assigned for solemnization of marriage.

Step-4: A day prior to the date of solemnization of marriage/registration bride / bridegroom or both should visit Consulate and check draft Marriage Registration Certificate. .

Requirement of documents for Solemnization of Marriages at Consulate:

(1) Marriage of Indian national with Indian national

(i) Marriage Registration Fee AED 198 (Service fee- AED 190+ ICWF - AED 8)

(ii) Original passport and Passport copy, visa copy and emirates ID copy of prospective bride and groom.

(iii) Singleness Certificate* / Divorce decree / Death certificate

(iv) 4 passport size photographs of Bride & Groom
(v) Original passport and self attested passport copy, visa copy and emirates ID copy of three witnesses.

(vi) Duly filled in form for ‘Notice of Intended Marriage’ (4 copies). [Form-I]

(vii) Duly filled in form for ‘Declaration by Prospective Bride and Groom’(2 copies) [Form-II]

NOTE:- *If bride /groom are on residence visa, they can get singleness certificate from SGIVS Global, Oud Metha, Dubai and if bride/ groom are on visit visa, he/she has to get singleness certificate from India.

(A Certificate of bachelorhood/single-status/eligibility to get married can be issued by a competent court/ SDM having jurisdiction of the area of the residential address of the applicant. This can be in the form of a certificate/ affidavit notarized by SDM which is required to be counter-attested by the Home Department of the State concerned. Thereafter, it is to be attested/apostilled by the Attestation Section of the Consular, Passport & Visa (CPV) Division of the Ministry of External Affairs, New Delhi)

(2) Marriage of Indian national with foreign national in addition to the requirement as above, following documents are required:

(i) A non-impediment certificate certifying the singleness of the foreign national from his/her respective Embassy/Consulate. It should be duly attested by the Ministry of Foreign Affairs, Government of UAE. If the Embassy/Consulate does not issue such certificate, a Sworn Affidavit attested by the respective Embassy/Consulate needs to be submitted.

(ii) A certificate from the Consulate of the foreign national stating that his/her country’s respective law does not prohibit their nationals from marrying foreign nationals.

NOTE: Singleness Certificate prior to date of marriage is mandatory for Marriage Solemnization / Registration at Consulate.

 
B. PROCEDURE FOR REGISTRATION OF MARRIAGE THAT SOLEMNIZED OUTSIDE THE CONSULATE AT CHURCH / GURUDWARA / TEMPLE

Requirement of documents for Registration of Marriages:

(1) Marriage of Indian national with Indian national

(i) Marriage Registration Fee AED198 (Service fee- AED 190+ ICWF - AED 8)

(ii) Original passport and Passport copy, visa copy and emirates ID copy of prospective bride and groom.

(iii) Singleness Certificate of both bride & bridegroom*/Divorce decree/Death Certificate

(iv) Original passport and self attested passport copy, visa copy and emirates ID copy of three witnesses

(v) 2 passport size photographs of Bride & Groom

(vi) Marriage certificate issued from Church / Gurudwara / Temple

(vii) Duly filled in form (Registration of foreign Marriage at the Consulate General of India, Dubai) Separate form filed by bride and groom. [Form-III]

NOTE:- *(a) If bride /groom are on residence visa, they can get singleness certificate from IVS Global, Oud Metha, Dubai.

(b) If bride/ groom are on visit visa, he/she has to get Singleness Certificate from India. NOTE-1: Validity of Documents -  As a practice, the documents issued in UAE are considered to be valid for 3 months from the date of issue and those issued outside UAE are considered to be valid for 6 months, if no validity is specified.

NOTE-2: If marriages  solemnized outside Consulate, Singleness Certificate prior to date of marriage is mandatory for  Registration of Marriage at Consulate 

C. DIVORCEE: REQUEST FOR MARRIAGE SOLEMNIZATION/ REGISTRATION IN SUCH CASES ARE CONSIDERED ON CASE-TO- CASE BASIS.

If a Divorce Decree has been issued in India, it should be attested by the Home Department of the State where the decree has been issued, and Ministry of External Affairs (MEA), New Delhi. 

For a decree issued in the UAE, its legal English translation, attested by the MOFA Ministry of Foreign Affairs (MOFA) needs to be submitted for Consulate’s consideration. 

For a decree issued in a 3rd country, its English translation, attested by its Foreign Office and / or Indian Mission there or MOFA (in case of a foreign national) needs to be submitted for Consulate’s consideration.

The procedure may take a minimum period of 45 days from date of publication of advertisement.
